Glancy Binkow & Goldberg LLP announces that all purchasers of the common stock of Ignite Restaurant Group, Inc. (“Ignite” or the “Company”) (NASDAQ:IRG) pursuant and/or traceable to the Registration Statement and Prospectus issued in connection with the Company’s May 10, 2012 initial public offering (the “IPO”), have until September 18, 2012 to file a motion with the Court to be appointed as Lead Plaintiff. The securities fraud class action lawsuit was filed in the United States District Court for the Southern District of Texas.

Ignite, together with its subsidiaries, owns and operates restaurants under the Joe’s Crab Shack and the Brick House Tavern+Tap brands. The Complaint alleges that the Registration Statement and Prospectus issued in connection with the Company’s IPO contained material errors, dating back to the Company’s inception, related to the Company’s accounting treatment of leases.

On July 18, 2012 Ignite announced that following an internal assessment of its lease accounting policies, the Company has determined that it is necessary to correct non-cash related errors related to its accounting treatment of certain leases. On July 19, 2012, following the Company’s announcement, shares of Ignite declined precipitously, more than 20%, on unusually heavy volume.

Glancy Binkow & Goldberg LLP announces that a class action lawsuit has been filed in the United States District Court for the Eastern District of North Carolina on behalf of all persons who acquired the common stock of Duke Energy Corporation (“Duke” or the “Company”) (NYSE:DUK) in connection with the Company’s merger (the “Merger”) with Progress Energy Inc. (“Progress”), and all persons who purchased or otherwise acquired Duke common stock between June 28, 2012 and July 9, 2012 (the “Class Period”).

Duke, together with its subsidiaries, operates as an energy company in the United States and Latin America. The Complaint alleges that the Company failed to disclose and misrepresented that: (i) Duke’s current chief executive officer, James E. Rogers (“Rogers”) – and not William D. Johnson, who before the Merger was the head of Progress – would serve as the CEO of the combined Company after the Merger: and (ii) approval for the Merger was obtained from the Progress board of directors by failing to disclose that Rogers would act as the CEO of the combined company.

Glancy Binkow & Goldberg LLP, representing investors of New Oriental Education & Technology Group Inc. (“EDU” or the “Company”) (NYSE:EDU), announces that all purchasers of the American Depositary Shares of EDU between July 21, 2009 and July 17, 2012, inclusive (the “Class Period”), have until September 21, 2012 to file a motion with the Court to be appointed as Lead Plaintiff. Rebecca Rusch and Alban Lakata conquered more than 100 miles of challenging Colorado Rockies terrain and elevations as high as 12,424 feet to be crowned champions at this year’s Leadville Trail 100 MTB. Nearly 2,000 riders from 50 states and 35 countries descended upon Leadville, Colorado, to take on the country’s most prestigious ultra-distance mountain bike race.

Rebecca Rusch (Ketchum, Idaho) won the women’s division at 7:28:06, shattering the previous women’s record she set last year by more than three minutes. She’s the only woman in Leadville Trail 100 MTB to win four times. Among the women’s division, Sally Bigham (Poole, England) finished second at 7:34:35 and Pua Mata (Anaheim Hills, California) finished third at 7:38:04.

Competing against a stellar field of some of the country’s best mountain bikers on the 103-mile course, Alban Lakata (Lienz, Austria) won the men’s division at 6:32:24. Lakata held off Christoph Sauser (Sigriswil, Switzerland), who finished second at 6:34:51, and Jeremiah Bishop (Harrisonburg, Virginia), who finished third at 6:41:58.

The renowned Leadville Trail 100 MTB is the original ultra-distance mountain bike event, beginning and ending in the heart of Leadville located west of Denver. Since 1994, the Leadville Trail 100 has been attracting thousands of racers to the Colorado community.

The weekend also tested the fortitude of the 84 athletes competing for the title of Leadman and Leadwoman. Since June, each Leadman and Leadwoman athlete has competed in the Leadville Trail Marathon, Leadville Silver Rush 50-Mile Mountain Bike Race or Silver Rush 50-Mile Trail Run Race, Leadville Trail 100 MTB Race, and Leadville 10K Run.

One month ahead of its third annual meeting, the Leadership Council on Legal Diversity (LCLD) has reached the 200-member milestone. It is also seeing registrations for its annual meeting, scheduled for Sept. 13 in Washington, D.C., double the number of last year’s.

With July 2012 on record as being one of the hottest months in U.S. history and the August heat showing no let up in many parts of the country, how can parents protect their children’s health during a heat wave? “While kids and teens may think of themselves as invincible, they’re prone to heat-related illnesses,” says Megan Summers, a registered nurse in the Children’s Hospital Los Angeles’ Rehabilitation Unit. “With summer temperatures rising, it’s appropriate to talk about common heat-related illnesses and ways to keep your kids and teens safe in the heat,” she says.

“Cars with no or poor air conditioning can be saunas”

The National Oceanic and Atmospheric Administration reports that heat is the number one weather-related killer in the United States, resulting in hundreds of fatalities each year. In addition, the American Academy of Pediatrics states that heat stroke is one of the common causes of exercise-related death in high school students in the United States. “Heat-related illness is more common than one may believe,” says Alan Nager, MD, MHA, director of Emergency and Transport Medicine of Children’s Hospital Los Angeles.

To better inform parents on the symptoms and remedies of heat-related illnesses in children, Summers and Nager have identified signs of heat-related illnesses and provide recommendations on important do’s and don’ts when temperatures soar.

What are the Three Main Categories of Heat-Related Illness?

As a parent or guardian, it’s important to recognize when heat-related illnesses affect your child and how to effectively treat it.

1. Heat Cramps/Edema/Syncope – These are the mildest of the three heat-related illnesses. Heat cramps are common in children and young athletes. Common symptoms are muscle pain, tightness and spasms. Heat Edema – This is usually the result of being unaccustomed to hot/humid temperatures. Common symptoms are swelling of the hands and feet. Heat Syncope – This results from overheating, and having a low intake of water and salt. Symptoms include pale skin, fatigue, light-headedness and fainting.

2. Heat Exhaustion – This is severe and is a result of water and salt loss from the body from excessive sweating. Heat exhaustion occurs in conditions of extreme heat without adequate fluid and salt replacement. If heat exhaustion is not treated, it can develop into heat stroke. Common symptoms are extreme tiredness, dizziness, nausea or vomiting, rapid pulse, pale or flushed skin and profuse sweating. Treatment includes the administration of cool liquids, use of fans, cooler or cold environment.

3. Heat Stroke – This is extremely serious. It occurs when the body’s temperature rises rapidly to an excessively high degree and the body is unable to cool down. Heat stroke is a life-threatening emergency and requires IMMEDIATE medical attention. Common symptoms are body temperature higher than 104 degrees, low blood pressure, disorientation, loss of consciousness, seizures. Treatment includes care in an emergency department. Care given will include ice packs, intravenous fluids, lab testing and transfer usually to a critical care unit.

What You Should Do When Heat-Related Illness Strikes

Whether you’re witnessing heat cramps or heat stroke, you should ALWAYS:

  • Remove your child from the activity they are playing
  • Get out of direct sunlight
  • Give your child plenty of water or liquid with electrolytes such as a sports drink

Why are Children and Teens Vulnerable?

Children and teens are busy and may not be able to recognize the symptoms of heat-related illness. Children don’t realize they need rest breaks or drink enough fluids. Additionally, infants and young children must rely on other people to pace their activity and keep them cool and hydrated.

Teens, especially young athletes may think they can “push through” the heat and ignore symptoms. Educating children and teens about the importance of adequate and proper hydration, as well as the dangers of heat-related illness, is critical in reducing the risk of heat injury.

Heat-Related Illness Prevention Tips

Important tips – while staying in-doors if it’s extremely hot outside is easier said than done, keep these tips in mind to protect your child:

  • Wear lightweight, light-colored and loose-fitting clothing.
  • Wear a hat.
  • Wear sunscreen with a sun protection factor (SPF) of 30 or more and apply this every hour. For more information on sunscreen safety and the FDA’s new regulations that come into effect this year see my previous blog post, “Sunscreen Safety: Understanding the FDA’s New Regulations
  • Drink plenty of fluids to prevent dehydration, such as water or an electrolyte enhanced drink like Gatorade.
  • Your child should drink fluids every 15 to 20 minutes.
  • Avoid fluids containing caffeine or alcohol. Caffeine and alcohol actually make you more dehydrated and susceptible to heat-related illness.
  • Plan your activities around cooler times of the day, for example before 10 a.m. and after 4 p.m.
  • Take frequent rest breaks in a cool and shady area.
  • For older children and teens, use a “buddy system” to keep an eye on each other. Take rest breaks and drink enough fluids.
  • If you or your child is taking prescription medication or has a chronic condition, please consult with the physician regarding outdoor activity.
  • Restrict car trips to the earlier and later part of a hot day. “Cars with no or poor air conditioning can be saunas,” Nager says.

“Hopefully, this information helps you feel more prepared to be outdoors and how to handle heat-related illnesses if it occurs,” says Summers. “Now go have fun and enjoy the summer!”

The country currently contains recoverable shale gas reserves of between 12.4tcf and 27.4tcf, with maximum recoverable shale gas reserves at 68.6tcf, which if exploited can provide for at least 24 years of the country's natural gas needs at current consumption rate. Representing around 30% of the total European shale gas market, Poland is aiming to maintain this dominance through numerous exploration projects and concessions.

The average waiting time for an appointment in regular clinics surveyed in 10 metropolitan US states is 20.3 days; whereas in a retail clinic a customer can walk in and use any of the services with a maximum waiting time of 15 minutes. In addition to being in convenient locations, retail clinics are open throughout the week, including during evening hours, at fairly low costs in comparison to regular clinics.

The booming retail clinic industry lowers the costs for health insurance policy makers, who can divert minor conditions to retail clinics, reducing costs and the number of emergency room visits. The Convenient Care Association is a US trade association, whose member clinics constitute more than 90% of all retail clinics. The association helps to standardize operations, establish exemplary practices, and share resources to drive growth in the retail clinic industry, ensuring that high standards are met by clinics across the country.

Magyar Telecom B.V. (“Matel B.V.”) announced today its financial results for the quarter and six months ended June 30, 2012.

RESULTS FOR THE SIX MONTHS ENDED JUNE 30, 2012

The results for the six months ended June 30, 2012 reflect the consolidated financial results of Magyar Telecom B.V. and its subsidiaries (collectively, the “Company”) in accordance with International Financial Reporting Standards (“IFRS”).

The reporting currency is euro (“EUR”), however the functional currency of continued operations is the Hungarian forint (“HUF”), being the currency of the primary economic environment in which the Company operates.

When comparing the financial results for the six months ended June 30, 2012 to the financial results for the six months ended June 30, 2011, the reported results in euro have been affected by the difference between the average HUF/EUR exchange rates. The Hungarian forint depreciated against the euro by 10% with an average HUF/EUR exchange rate of 295.64 during the six months ended June 30, 2012 compared to the average HUF/EUR exchange rate of 269.38 during the six months ended June 30, 2011. This change in exchange rates had an impact on Hungarian forint denominated earnings when converted into euro.

The Company’s revenue was EUR 84.8 million for the six months ended June 30, 2012 which represents a 15% decrease compared to the six months ended June 30, 2011. Segment gross margin decreased by 14% from EUR 81.8 million for the six months ended June 30, 2011 to EUR 70.0 million for the six months ended June 30, 2012. General operating expense decreased by 6% from EUR 41.6 million for the six months ended June 30, 2011 to EUR 39.1 million for the six months ended June 30, 2012. Income from operations decreased to EUR 3.8 million for the six months ended June 30, 2012 from EUR 8.6 million for the six months ended June 30, 2011, mainly as a result of the decrease in segment gross margin. Net result for the six months ended June 30, 2012 was a net loss of EUR 23.4 million compared to a net income of EUR 18.9 million for the six months ended June 30, 2011, which includes the gain of EUR 28.5 million accounted for in relation to the acquisition of Fibernet.

Residential Voice – Residential Voice segment gross margin was EUR 17.0 million for the six months ended June 30, 2012, representing a decrease of 27% compared to the six months ended June 30, 2011. The decrease was mainly due to the decrease in our Residential Voice revenue as a result of the decrease in the number of customers and traffic and the 10% depreciation of the HUF against the EUR during the six months ended June 30, 2012 compared to the prior year.

Residential Internet – Residential Internet segment gross margin was EUR 12.9 million for the six months ended June 30, 2012, representing a decrease of 10% compared to the six months ended June 30, 2011. The decrease was mainly due to the 10% depreciation of the HUF against the EUR during the six months ended June 30, 2012 compared to the prior year. In functional currency terms, Residential Internet segment gross margin was flat year over year.

Cable - Cable segment gross margin was EUR 6.2 million for the six months ended June 30, 2012 compared to EUR 4.9 million for the six months ended June 30, 2011. The Cable segment was introduced as of March 1, 2011 and relates to the revenue generated by the ex-Fibernet business.

Corporate – Corporate segment gross margin was EUR 22.9 million for the six months ended June 30, 2012, representing a decrease of 12% compared to the six months ended June 30, 2011. The decrease was mainly due to the decrease in Corporate Voice revenue as a result of loss of lines and price erosion due to competition and the 10% depreciation of the HUF against the EUR during the six months ended June 30, 2012 compared to the prior year.

Wholesale – Wholesale segment gross margin was EUR 11.0 million for the six months ended June 30, 2012, representing a decrease of 15% compared to the six months ended June 30, 2011, which is mainly due to the 10% devaluation of the HUF against the EUR compared to the prior year, and the decrease in small bandwidth wholesale leased line revenue.

Segment gross margin is a non-IFRS financial measure, which is used by management to evaluate the performance of the business segments. The following table represents the reconciliation of segment gross margin to income from operations as per the Consolidated Statement of Comprehensive Income / (Loss) of the Company:

Net cash provided by operations, which includes interest paid but excludes capital expenditure and debt repayments, was EUR 11.9 million for the six months ended June 30, 2012.
